The Supreme People’s Procuratorate sets up an Intellectual Property Inspection Office

On November 6, the Supreme People’s Procuratorate established an Intellectual Property Prosecution Office in the form of an internal comprehensive case handling organization. This time, the Supreme People’s Procuratorate set up the office to be responsible for the top-level design and strategic planning of intellectual property procuratorial work, as well as the handling, supervision and business guidance of criminal, civil, and administrative cases of intellectual property infringement required by the procuratorial agency.

Zhang Jun said that it is necessary to handle cases involving intellectual property procuratorial supervision, and to find and summarize common problems through intellectual property prosecutions, and actively put forward legislative suggestions, promote the improvement of relevant laws and systems, reduce the cost of intellectual property protection, and increase the cost of illegal tort crimes.

In addition, it is necessary to promote the comprehensive use of administrative, economic, and legal means to increase the protection of intellectual property rights. For those who constitute a crime, not only should the free punishment be used, but also the use of property punishment should be emphasized. “Let the offender pay the price that should and must pay”, Zhang Jun said.

The reporter learned that in terms of intellectual property procuratorial protection, the difficulty of investigating and collecting evidence is a problem in practice. Zhang Jun said that in terms of evidence collection, it is necessary to explore suitable methods of obtaining evidence for handling intellectual property cases, effectively overcome the difficulty of producing evidence, minimize the cost of obtaining evidence, and improve the quality and efficiency of case handling.
