On the afternoon of November 30, Beijing Daxing Court issued more than 3.3 million yuan in arrears of salary to 81 applicants for enforcement. It is reported that the person being executed is the chip company "Jingwei Yage", who owes salary due to business difficulties. When the court's enforcement encountered a bottleneck, in February 2018, a piece of news that "Jingwei Qili was born again from Jingwei Yage" was noticed by the enforcement judge. It turned out that "Jingwei Qili" used some of the patents of the executor to start again. In order to allow employees to get arrears of wages, and to enable the growth of new technology companies, the enforcement judges "live seal" the patent. Nowadays, the implementation of the "release of water to raise fish" has achieved results.
From 2016 to 2019, the Executive Bureau of Daxing Court successively received 86 labor dispute cases between Jingwei Yage (Beijing) Co., Ltd. (Jingwei Yage) and employees of the company, and the total amount of subject matter of execution was nearly nine million yuan.
At the end of 2016, the first batch of more than 40 executors applied to the court for compulsory execution of Jingwei Yage Company's property, and the execution target was nearly five million yuan. The executive judge learned that in May 2016, Jingwei Yage Company encountered operational difficulties, and it was not easy to execute the money back.
In February 2018, a report caught the attention of Liang Dong, assistant judge of the Executive Board. According to the report, eight employees of the original Jingwei Yage Company used the company's patented technology to start a new business and established Jingwei Qili Company.
At this time, the number of cases that Jingwei Yage has entered the court enforcement procedures has reached 86.
Liang Dong immediately contacted Jingwei Qili Company to understand the situation, and the executive judge decided to "live the patented water and raise the big fish for start-ups" to help Jingwei Qili Company grow and create conditions for "re-dividing the cake".
In August 2019, Jingwei Qili Company took the initiative to contact the Daxing Court to resolve the issue of the original Jingwei Yage Company’s wages. Jingwei Qili Company proposed three sets of distribution plans. Due to the failure to reach an agreement with the applicant for some terms, the financing was not successful due to the impact of the epidemic, and the settlement had to be suspended.
In mid-October 2020, Jingwei Qili Company, which has successfully raised funds, contacted the Daxing Court again to mediate with the executors on matters that failed to reach a settlement in 2019. After many coordination and communication, Jingwei Qili finally contacted the 81 employees and reached a preliminary agreement, and the remaining salaries were finally settled.
In the past four years, the properly settlement of Jingwei Yage's series of cases was inseparable from the resilience of the judge, the responsibility of the enterprise, and the understanding of the applicant. The three parties have worked together to create a good situation for all parties.
