On December 1, the first intellectual property prosecution office in Fujian Province was unveiled at the Procuratorate of Gulou District, Fuzhou. It is reported that the Fuzhou Intellectual Property Prosecutors Office will be responsible for the review, prosecution and litigation supervision of criminal cases of intellectual property infringement in Fuzhou, handling civil and administrative application supervision cases involving intellectual property rights and public interest litigation cases in the field of intellectual property in Gulou jurisdiction; establishing professional intellectual property prosecutors joint conference mechanism to explore appropriate methods of obtaining evidence for handling intellectual property cases, jointly with public security organs and judicial organs to issue evidence standards, sentencing guidelines and other case handling norms, and promote the notification of rights and obligations of rights holders in criminal cases of intellectual property infringement; joint intellectual property administrative departments to establish related intellectual property joint meetings, information sharing, case transfer and other mechanisms, work with universities to strengthen research on difficult and complex issues in intellectual property protection; provide enterprise-related intellectual property cases or similar cases of fact identification and legal application consultation and guidance, intellectual property legal risks evaluation and other services help companies improve the internal mechanism of intellectual property protection.
Fuzhou is among the first batch of "National Intellectual Property Demonstration Cities." Since 2010, criminal cases involving infringement of intellectual property rights in Fuzhou have been handled by the Gulou District Procuratorate. They hired four experts and scholars from Xiamen University, Tongji University and other universities to form an advisory committee to assist in solving various new, difficult, and complex problems encountered in handling cases. Since the beginning of this year, the institute has also organized the "Local Intellectual Property Brand Protection" and "Intellectual Property Rights Protection Assistance Services" seminars in collaboration with Fuzhou Lawyers Association, Fuzhou Intellectual Property Center, Fujian Normal University and other university research institutes to further improve the prosecutor’s professional competence.
The Gulou District Procuratorate increased its awareness of active service and promoted the sinking of prosecutorial power. Through holding an open day for procuratorial services for private enterprises, an IP-themed press conference, and the release of the “Three Ones” procuratorial activities of the White Paper on Criminal Judicial Protection of Intellectual Property Results. In 2019, the court independently developed a “cloud platform” for intellectual property prosecution and legal services, using big data analysis to assist in case handling, and providing enterprises with judicial risk assessment, efficient services and rights protection channels, and was awarded the 2020 National Political and Legal Intelligent Construction Excellent Innovation Case; Over the years, the Gulou District Procuratorate has successively won the first and third prizes of the national meritorious unit in combating infringement and piracy cases, and the "First Prize of Meritorious Individuals"; in October 2020, the experience and practice of the court "Improve the quality of intellectual property inspection, serve innovative development of enterprises" were selected as a typical case of the advanced construction of the Supreme Procuratorate's national new era grassroots procuratorates. It is also one of the two typical cases selected by Fujian province.
