Illegally set up private game server during probation, the defendant was sentenced a year and ten months imprisonment

Recently, the People’s Court of Yueyang County, Hunan Province heard a copyright infringement case by the law. The defendant Gou was sentenced to ten months’ imprisonment and fined RMB 100,000 for the crime of copyright infringement. The probation announced for the crime of copyright infringement shall be executed with fixed-term imprisonment of one year and three months; the decision has been made to execute fixed-term imprisonment of one year and ten months, and a fine of RMB 100,000. The illegal proceeds detained by the Public Security Bureau shall be confiscated and turned over to the national treasury.

 

In April 2020, Gou, with the purpose for making a profit, used his previous experience in set up "Dragon Oath" game private server, utilized the server to set up "Dragon Oath" without authorization or permission of one of the Beijing Digital Technology Company. Gou used a private server to illegally operating the company’s copyrighted "Dragon Oath" online game. After debugging the game, Gou contacted a third-party recharging platform to collect recharge fees for game players to purchase game equipment. During the operation of the private game server, Gou successively promoted the private game on several websites and provided the client to log in for game players to download. In order to expand the visit amount of private server games, Gou successively promoted the private server games on game promotion websites.

 

From June 1 to July 29, 2020, Gou illegally operated the "Dragon Oath" online game. The total amount of illegal operations was 119,148 yuan, and the illegal profit was more than 50,000 yuan. It was also found that on September 5, 2018, the defendant Gou was sentenced to one year and three months imprisonment, suspended for two years, and fined 100,000 yuan by the Jiangsu Higher People’s Court for the crime of copyright infringement.
