On February 10, the Yinchuan Intermediate People's Court held a press conference to release a white paper on judicial protection of intellectual property rights, comprehensively introduced the status of judicial protection of intellectual property in Yinchuan two-level courts from 2018 to 2020, and announced five typical cases of intellectual property rights.
In recent years, Yinchuan Court has focused on implementing new development concepts and promoting high-quality development, gave full play to the role of judicial functions, comprehensively improved the strength and level of judicial protection of intellectual property rights, and strive to provide strong judicial service guarantees for promoting the high-quality economic development of Yinchuan City. In the past three years, 1,325 civil cases involving intellectual property rights were accepted, and 40 people accepted 24 criminal cases involving intellectual property rights in the first and second instance. The number of cases ranked first in the region. A series of significant intellectual property dispute cases were concluded, and clear, stable and predictable guidelines for adjudication rules were provided to social innovation entities. The demonstration effect of IP judicial protection was further highlighted, and judicial credibility and influence were further enhanced. While giving full play to the role of the main channel of civil trials, they also paid attention to the role of criminal trials, especially for food safety, daily necessities and other intellectual property crimes related to people's lives, health and social stability. Yinchuan Court extensively used various penal methods, emphasizing the use of property penalties to increase penalties for infringement of intellectual property rights, and a total of 9.633 million yuan was fined. Yinchuan Court has promoted the reform and innovation of the intellectual property judicial system, implemented the "three-in-one" of intellectual property adjudication, and optimized intellectual property adjudication resources allocation. They adhered to the advancement of non-litigation dispute resolution mechanisms, actively explore the "one-stop" diversified solution model, establish a roster of specially invited mediators and expert jurors for intellectual property rights, and integrate the working principle of "mediation priority and mediation combined" throughout the whole process of intellectual property right trial.
The president of Yinchuan Intermediate People's Court took the lead in trying criminal cases of counterfeiting registered trademarks. Many typical cases and judgment documents were selected into the 50 typical intellectual property cases and one hundred outstanding national courts' judgment documents. The Third Civil Tribunal of Yinchuan Intermediate People's Court was rated as National Court Advanced Collective of intellectual property right trial.
