On February 19, the Supreme People's Procuratorate, the State Administration for Market Regulation and the State Drug Administration jointly issued 15 typical cases of special actions to implement the "four strictest" requirements for food and drug safety. The counterfeit "Quanjude" trademark case is one of them. The eight defendants were sentenced to fixed-term imprisonment of one year, three months to three years and six months, and a fine of 30,000 to 600,000 yuan.
The case originated from more than 230,000 pieces of unauthorized packaging materials with the registered trademark "Quanjude" seized by law enforcement officers. In this case, there were defendants responsible for purchasing packaging materials with counterfeit registered trademarks, some defendants were responsible for assembling "fake roast duck", and someone was responsible for sales... The eight defendants set up an entire industrial chain of production, processing and sales of "fake roast duck".
"This case is a typical case of trademark infringement in the entire chain of 'providing counterfeit packaging materials in the upstream-processing -- production in small workshops in the middle reaches -- downstream of tour guides selling to tourists at the end." The relevant person in charge of the Supreme People's Procuratorate introduced, the typical significance of this case is that the procuratorial bureaus strengthened communication and coordination, cracked down on counterfeiting crimes in a full chain and precise manner, and conducted consultations with the public security bureaus for the fixed collection of evidence in the case and the application of laws. Based on this case, the mode of making and selling fakes is mainly online; it is recommended that the public security organs focus on collecting and extracting electronic data such as WeChat chat records. Based on full communication and consolidating evidence, the procuratorial agency approved eight people's arrest and prosecution, including Zhang. The court accepted all the public prosecution opinions and realized the full chain and precise crackdown on counterfeiting and infringement crimes.
It is understood that from September 2019 to December 2020, the Supreme People's Procuratorate, the State Administration for Market Regulation and the State Drug Administration jointly launched a special action to implement the "four strictest" requirements for food and drug safety. The national procuratorial bureaus, market supervision departments, and drug supervision departments have increased their coordination and adopted various effective measures to achieve positive results in accordance with local conditions.
According to preliminary statistics, during the launch of the special action, the national market supervision department investigated and handled 284,800 food safety violations and fined 2.725 billion yuan; the drug regulatory department investigated and handled 107,700 illegal cases in the fields of drugs, cosmetics and medical devices, and fined 1.84 billion yuan. The procuratorial bureau approved the arrest of 3,945 crimes and 7,298 people involving food and drug safety, and prosecution of 8,791 cases of 17,066 million people.
