Inner Mongolia’s "Blue Sky" Special Action Strictly Investigate Improper Patent Application Behaviors Not for the Purpose of Innovation

In order to strengthen agency supervision, the Inner Mongolia Autonomous Regions Market Supervision Administration and the Intellectual Property Office have strengthened the supervision of intellectual property agencies in the Inner Mongolia Autonomous Region during and after the event, encouraged genuine innovation, and launched a "blue sky" special action throughout the region, focusing on combating improper patent application behavior without the purpose of innovation.

 

According to reports, the improper patent application activities that are not for the purpose of innovation refer to the six situations stipulated in Article 3 of the "Several Provisions Regarding the Regulation of Patent Application Activities" (China National Intellectual Property Administration Order No. 75): entities or individuals deliberately submit related patent applications separately; submit patent applications that are obviously inconsistent with their research and development capabilities; entities or individuals resell patent applications improperly; patent applications submitted by entities or individuals have technical solutions to achieve simple functions with complex structures, and adopt conventional or the combination or stacking of simple features is obviously not in line with the common sense of technological improvement; other behaviors that violate the principle of good faith stipulated in the Civil Code, do not comply with the relevant provisions of the patent law, and disrupt the order of patent application management. Up to now, there have been 991 irregular patent applications in the Inner Mongolia Autonomous Region that are not intended for innovation, and the applicant has voluntarily withdrawn 629 patent applications.
