Earlier yesterday (March 31,2022), the 38th Session of the Fifteenth Standing Committee of the Beijing Municipal People's Congress voted to pass Regulations on the Protection of Intellectual Property Rights of Beijing (《北京市知识产权保护条例》), for better protection of the city’s intellectual property.
The draft of the newly-passed Regulations has been deliberated twice by the Standing Committee of Beijing Municipal People's Congress on September 23, November 25 in 2021 respectively.
Regulations consist of seven chapters and fifty-seven articles, covering four aspects: administrative and judicial protection of intellectual property, intellectual property protection in key emerging fields, construction of intellectual property public services, and mediation of intellectual property disputes.
For administrative and judicial protection of intellectual property, Regulations clearly strengthen the administrative and judicial protection, to improve its quality and efficiency, while focusing on emerging fields and key areas.
The construction of relevant public service system including patent pre-trial, guidance on rights maintenance, patent navigation establishment, etc., has been called on in Regulations to promote high quality creation and utilization.
Regulations also require promotion of diversified solutions to intellectual property disputes, propelling disputes’ rapid resolution.
The Regulations will soon come into effect on July 1, 2022.
