Reported by the CNBC on March 11, 2019, scientific technological giant Microsoft has decided to sue Foxconn’s parent company, Hon Hai, because it failed to comply with a patent-licensing agreement.

According to the report, Microsoft is seeking royalty repayments with interest, attorney fees and a review of Hon Hai’s books.

Up to now, it’s still not revealed that which products are involved in the agreement while Microsoft stated that it signed a deal covering Android and Chrome OS devices with  Hon Hai in 2013. The transcript of the agreement has been submitted to the court and stays confidential.

It’s known that Foxconn doesn’t obey the patent license agreement signed in 2013. According to the plaint filed by Microsoft to the Northern District Court of California, Microsoft accused Hon Hai for not providing patent license reports on certain products twice a year and refusing to pay on time.

The court document points that Hon Hai accepted audit by a third party, Deloitte, in 2017 but didn’t submit any files of request.

“Microsoft takes its own contractual commitments seriously and we expect other companies to do the same,” a Microsoft spokesperson was quoted as saying by the cited source. “This legal action is simply to exercise the reporting and audit terms of a contract we signed in 2013 with Hon Hai. Our working relationship with Hon Hai is important and we are working to resolve our disagreement.”
