Executive Meeting of the State Council : Strengthen IP Protection , Implement Credit Supervision
IP Protection
On March 26, 2019, Premier Li Keqiang hosted the executive meeting of the State Council, aiming to implement arrangements on reducing social insurance fee rates, clarify specific supporting measures; decided on the year's priorities for improving the business environment to unlock market vitality.; adopt the draft of the PRC Food Safety Law.
The meeting stressed that comprehensive IP protection should be strengthened,and credit supervision should be implemented so as to build a vital, open and orderly market.
All parts should implement the arrangements made by the CPC Central Committee and the State Council, reach a higher level, focus on weaknesses, improve the business environment and unleash market vitality and social creativity. The following measures are required . Firstly, streamlining administration.is very important, such as shrinking the negative list of market access, separating permits from the business license, streamline the examination and approval of construction projects and reduce industrial production licenses. By the end of 2019, the time for the establishment of enterprises should be reduced to 5 working days and the time for that of transacting power consumption business into 45 working days in order to solve the problems of taxation, credit access, enterprise de-registration and bankruptcy which are reflected on most. Second, it’s stressed that in order to accelerate the speed of abolishing or modifying relative regulations based on the Competitive Neutrality principle, it’s necessary to modify or abolish those regulations interfering equal competitions, restraining development of private enterprises or making exceptions for foreign enterprises. By then end of 2019, the equal competition censorship system will cover governments of 4 levels including the nation, provinces, cities and counties. Following regulations, policies or rules will be all censored by the system with a mechanism of complaints reports and the third-party evaluation in order to prevent or rectify such regulations from excluding or restraining competitions and not providing supports for those fall behind. The third point is to propel justice supervision and rectify the problems of unqualified supervision and non-implementation for responsibilities distribution for enterprises by the government. It’s asked to establish a compensation and penalty system involving problems concerning the public’s health to punish those enterprises and persons in charge who break the laws to commit serious consequences severely. It’s necessary to strengthen the IP protection, promote credit supervision and build a market of dynamic and equality.
The Regulation on the Implementation of the Food Safety Law of the People's Republic of China Draft was passed after the meeting. The draft clarifies the main responsibility, governmental responsibility in supervision and accountability measures, intensify the strength of penalizing those enterprises, legal representatives and other persons in charge according to laws. And a series of regulations including food safety standards and risk monitoring are perfected to ensure the food safety and safeguard the people’s health.
