Guangdong Patent Incentive Measures
Currently, the newly revised Guangdong Patent Incentive Measures (the Measures) will be implemented on May 1, 2019 and the old version published on August 27, 2014 will be abolished.
The revised Measures mainly adjusted and improved three aspects including patent awards, report and evaluation mechanism and award and penalty system.
The Measures adds new awards and increases the bonus. Each unit or individual that wins the gold prizes for patent or appearance design will be awarded 1 million Yuan; each unit or individual that wins the silver prizes will be awarded 500,000 Yuan; each unit or individual that wins the recognition award will be awarded 300,000 Yuan.
Meanwhile, the Measures revised and improved the report and evaluation mechanism, improved the standard, materials and methods of reporting, and refined and adjusted the review procedures.
Moreover, the revised Measures optimizes the reward and penalty mechanisms and stipulates that inventors’ promotion and assessment will be influenced by the number and type of prizes they are awarded. The Measure also upgrades the punishment measures for fraudulently obtaining the Guangdong Patent Award. As is stipulated in the Measure “if the Guangdong Patent Award is defrauded by providing false data, materials or other improper means, the Patent Administration Department of the Provincial People's Government shall report it to the Provincial People's Government for revoking the award, canceling the certificate and bonus, and publishing the illegal behavior on the media, and forbiding declaring the Guangdong Patent Award within five years.”
An officer of the Provincial Market Regulatory Administration said that the revised Measures can better serve the patent award, stimulate innovation, strengthen IP creation, application and protection, create a sound business environment for enterprise innovation, so that IP can become major pillar that propels high-quality development and accelerates innovation-driven growth.
