Watch out for IP Infringements of Military World Games
Military World Games
The Regulations on IP Protection of the 7th Military World Games in Hubei Province (the regulation) was officially implemented on April 1.
Ministry of National Defense, Wuhan Municipal Government and CISM agreed that it is a must to protect the ownership of title and slogan of International Military Sports and the concept of Military World Games. Current national laws and regulations on trademark, patent, copyright and commercial secrets alone are not enough to provide effective IP protection.
The regulation was adopted on January 25, 2019 by the Meeting of Executive Committee of Hubei Provincial People's Government and published later on February 11, 2019. The 19-article-regulation clarifies the scale and targets under protection, stipulates the mechanism and responsibilities of related departments and defined the application, details of IP protection and punishment against violation.
The following are eight kinds of violations of IP:
1. Using identical or similar marks, trademarks, patents to those of Military World Games for profit without permission;
2. Forging and manufacturing identical or similar special marks and trademarks without authorization or selling infringed marks and trademarks;
3. Counterfeiting marks, trademarks or patents;
4. Broadcasting, relaying, prerecorded broadcasting, rebroadcasting or webcasting the opening ceremony, closing ceremony and sports events without permission; making audio records or short videos on the scene or from media channels;
5. Derogating, distorting or changing the marks, trademark, patent, work or other IP products;
6. Selling infringed products for profit;
7. Providing facilitation such as warehouse, vehicles, mail or cover for the above infringements;
8. Other violations of IP according to the national laws and regulations.
