Highest Reward will be 500 Thousand Yuan in Guangdong for Reporting IP Infringements

The Rewards for Reporting IPR Infringements and the Production and Sale of Counterfeit and Shoddy Products (the Rewards) will come into effect since July 1. The maximum reward for a single report will be 500 thousand Yuan, while those who makes significant contribution will have higher rewards.

The Rewards has altogether 8 chapters with 31 articles. 14 categories specifies the content of the report, including piracy copying or infringing the right to exclusively use a registered trademark, counterfeiting others’ patents, forging or falsely making patent certificates, patent documents or patent application documents; incompatible with national, industrial or local standards that ensure personal and property safety; adulteration, faking and replacing qualified products with unqualified ones.

The Rewards regulates that the level of rewards can be categorized as A, B and C; the maximum reward for one single report is 500 thousand Yuan; if the whistleblower has a particularly significant contribution, the reward amount may exceed 500 thousand Yuan and it will not be capped within a certain standard.

Market regulatory departments of the local people’s government at or above the county level are responsible for the acceptance, transferring, investigation and regulation of the reports and management, review and distribution of the rewards. Market Supervision Bureau of Guangdong Province has opened multiple channels such as phone, fax, e-mail, QQ, Wechat and Weibo to accept related reports and is in charge of the management and operation of the smart regulatory platform.

At the press conference held by the group for crackdown on IPR infringement and the production and sale of counterfeit and shoddy products in Guangdong Province, Mai Jiaomeng, head of the group and Market Supervision Bureau of Guangdong Province, said, the group will strengthen operational mechanism, case investigation, coordination and cooperation, supervision and inspection, fully implementing the Rewards, stimulating public participation, improving the anti-counterfeiting regime so that infringement will have nowhere to hide and counterfeiters will have no money to prosper.
