Innovation-driven Economic Development Requires A Solid “Foundation” of “AI + IPR” for Innovation Protection

In the past year, the value of royalties paid to rights holders has risen to USD 35.6 billion, an increase of 19 folds compared with 2001. China’s efforts to foster an environment that respects knowledge and protects IPR can promote both IPR and innovation-driven economic development.

In recent years in innovation, China has evolved from a follower into a key player, especially some disruptive innovations in AI. However, despite much better innovations, China still has a long way to go to increase the number of innovations in terms of that of developed countries and its development stage. In fact, innovation and protection, in particular patent protection, should go hand in hand with each other. The aim of patent protection is to protect innovation. Only in this way will more individuals and enterprises be encouraged to engage in innovation. Therefore, emphasis should be given to the integration of AI and IPR to foster, improve and protect innovation.

With more than 100 domestic and foreign patents, Huang Weicai is an expert on patent strategy and operation for renowned enterprises in various fields. He, together with his team, has put forward several ideas: when it comes to innovation, he defines technology tracking, all-round expansion, gap definition and new factor innovation as “four steps of innovation”; meanwhile, big data can be used to track new technologies, new patents and developments of competitors to ensure that a company’s patent strategy is always “relevant”; in terms of patent protection, all-round development including top-level planning, horizontal expansion and bottom-level exploration can be applied; in addition, misunderstandings of group innovation and scenario innovation should be avoided to foster high-value patents for enterprises.

According to Huang, in practices, underlying technologies consist of NLP algorithm, technology and patent big data, data annotations, knowledge graph and AI; they can be used to provide middle-level services like discovering new technologies, providing innovation information, inventing tools and making patent planning; in this way, a top-level innovation application platform can be formed to facilitate technology and patent operation, as well as project incubation and financing.

In this year, a large number of IP-related policies have been adopted, which brings significant changes to the IP industry. With the development of big data and AI, innovative measures can be taken to empower “innovation”, which will lead us to an AI-driven innovation and an innovation-driven future.
