SPC IP Court Establishes Circuit Trial System
The reporter learned from the Supreme People's Court (SPC) that since the jurisdiction of its intellectual property court (IP court) covers the whole country, a circuit trial system will be established in the IP court. Under certain circumstances, the case will be heard in the court where the case is located or the original court. The circuit trial system aims to facilitate litigation by the parties and raise awareness of IP governance. It is scheduled for implementation in the second half of this year.
“To protect innovation in an innovative manner” is a guiding notion since the foundation of the SPC IP court. Luo Dongchuan, vice president of the SPC and chief of the IP court told the reporter that SPR IP court as a newly-established institution, attaches great importance to standardization and institutionalization. The court by now has established 40 court rules and regulations by the “1+N” mode, making itself gradually more scientific and standardized.
During its formal operation for half a year, the SPC IP court applied a series of advanced technologies such as AR glasses, voice recognition system, electronic signature system and electronic filing system. Besides, a database of adjudication rules has been preliminarily established. It collects the main adjudication documents of technical cases of the SPC in the past ten years into a database by summarizing key words and the main points of the adjudications. It clarifies that the collegiate court cases must be retrieved in the database. Without special procedures, latter cases should not conflict with the former ones, thus avoiding different judgments in similar cases to some extent. Later, the database will be further improved.
“We believe that under the firm leadership of the party group of the SPC, the IP Court, bearing in mind its original mission and taking the initiative, will surely make new achievements in providing effective judicial services and guarantees for building China a strong IP powerhouse with world-class scientific and technological capabilities.” said Luo.
