National Patent Agent Supervision to Realize Online Reporting Complaints

In order to further implement the educational requirements of "never forget the original intention and remember the mission" and promote the centralized rectification of "Blue Sky" special action, a new complaint module was added to the patent agency management system developed by the State Intellectual Property Office, which can support registered users to report and complain about illegal acts of patent agents online. The relevant person in charge of the Intellectual Property Application Promotion Department of the State Intellectual Property Office introduced that the complaint reporting channel has the functions of case reception, transfer, handling, case handling supervision and case information reporting. The channel has established a nationwide complaint reporting channel, which has a great significance of improving the efficiency of complaint handling and strengthening patent agency.

According to the relevant provisions, any entity or individual who considers that the practice of patent agencies or patent agents violates the relevant laws, administrative regulations and departmental rules governing patent agency administration, or considers that there exists a situation of unlawful patent agency business, may complain and report it to the local patent administration departments. After receiving complaints and reports, the relevant departments shall investigate and deal with them in accordance with the relevant provisions.

This time, after the new complaint reporting module is added, the patent agency management system supports registered users to fill in complaint information online, and when submitting complaints, they must fill in the true content of complaint reporting objects; the system will report complaints according to the content of complaints, and according to relevant regulations, allocate them to the corresponding local patent management departments for examination and verification. After examination and verification, the local patent administration department can file a case online, upload investigation materials, notify the applicant and make penalty decisions. In addition, the system improves the confidentiality mechanism of reporting complaints, effectively protects the lawful rights and interests of reporting complaints, and can make statistical analysis of information such as acceptance, transmission, handling and feedback of reporting complaints.

It is understood that the patent agent management system is mainly used for patent agents, agencies, local patent management departments and associations to deal with related affairs online, to achieve a "one-network" operation, but also to facilitate the community to inquire about relevant patent agent information.
