Case of counterfeiting "Nanfu" Trademark: Involving 300,000 Yuan, Seriously Endangering Personal Safety

Recently, law enforcement officers of the market supervision bureau of Changxing County in Huzhou City and local police officers seized 145,900 counterfeit "Nanfu" batteries and related parts and packages in a rental house of a residential district. Wu, a criminal suspect, was imprisoned for 10 years and worked in a battery factory after he was released from prison. When he heard that the profits of fake batteries were high, he rented a local house in early 2018. He bought labeling machines, press cards, white dry batteries and various kinds of packaging on the Internet. He began processing and packaging just by himself. Wu sold fake batteries processed and packed at a price of 0.80 yuan per unit to all parts of the country. In the past year, his amount of fake batteries sold has reached 300,000 yuan.

Market regulators said that fake batteries not only have small capacitance, but also may explode, which will seriously endanger the personal safety of consumers. Consumers should purchase batteries from regular businesses and be cautious in choosing batteries with low prices.

Because Wu’s behavior is suspected of counterfeiting registered trademarks, the circumstances are particularly serious. According to the Trademark Law, Administrative Punishment Law, Provisions for Transferring Suspected Crimes by Administrative Law Enforcement Organs, and the Supreme People's Court and the Supreme People's Procuratorate, solutions to some problems concerning the specific application of law in handling criminal cases of infringement of intellectual property rights are given. Interpretation and other relevant provisions, Changxing County Market Supervision Bureau has transferred the case to Changxing County Public Security Bureau for further investigation and treatment.

The Market Supervision Department of Zhejiang Province launched a special law enforcement action of "Red Shield, Net Sword", investigating 5191 cases and finding 14.5 million Internet advertisements suspected of violating the law. The public security organs launched a special action of "Blue Sword 2019" to crack down on intellectual property crimes. A total of 374 criminal cases were detected and 714 suspects were captured in agricultural and rural areas. Departments launched "Green Sword" law enforcement actions to crack down on agricultural illegal activities, investigate and punish 240 violations, and seize 38.83 tons of counterfeit and inferior agricultural inputs. Customs and propaganda departments respectively launched cross-border investigation and crackdown on infringement products and piracy cases.

It is reported that in the next stage, Zhejiang Province will focus on investigating and dealing with infringement and counterfeiting products related to people's livelihood and security, such as food, medicines, medical equipment, automobile accessories, special equipment, and so on; strengthening the supervision of key markets where infringement and counterfeiting are serious; strictly supervising the delivery links; and strengthening the security inspection system of receiving and sending inspection, real-name receiving and passing aircraft. We will step up efforts to crack down on the use of delivery channels to send infringing and counterfeit goods.
