The Case mainly involves in the determination problem on classification of network game products and services. The tutorial of standalone network game on the website of the Plaintiff is to serve the online-version network game; therefore, the download services of standalone and online clients provided on the website belong to the category of online game service that is approved for use by its trademark. For this purpose, the behavior of the Plaintiff in the Case does not constitute an infringement upon the Defendant’s trademark that is used in the approved computer game software products.
