In the first half of the year, the number of patent applications in China increased by 9.8%, and the number of trademark applications exceeded 4 million.

 

National Intellectual Property Administration of China held a regular press conference for the third quarter of the year on Thursday, July 9. The main work statistics and related information for the first half of 2020 was released.

 

In the first half of this year, the number of invention patent applications was 683,000, an increase of 5.2% year-on-year; the number of three types of patent applications was 2.195 million, an increase of 9.8% year-on-year; The examination cycle of patents and trademarks has been accelerated to varying degrees.

 

Hutong Yangtze River Bridge recently opened to traffic, with 65 patents help its construction.

 

The Hutong Yangtze River Bridge is a combined rail and road bridge which crosses the Yangtze River in Jiangsu, China. On its upper level, it carries a six-lane highway. On its lower level it carries four railway tracks with a design speed of 200 km/h. This is the second rail and road bridge on the Jiangsu section of the Yangtze River after the Nanjing Yangtze River Bridge. According to the person in charge of the Project of China Railway Major Bridge Engineering Group Co., Ltd, the bridge has made major breakthroughs in bridge construction technology, and has adopted many independently developed new materials and technologies, and has formed 65 patents.

 

Image copyright cases account for 40% of infringement, and the Beijing Internet Court proposes to standardize the image copyright market.

 

On July 7, the Beijing Internet Court held a press conference to explore the causes of image copyright disputes, promoted the resolution of disputes at the source, and issued a proposal to regulate the market for image copyrights. Since its establishment on September 9, 2018, the Beijing Internet Court has concentrated on hearing network-related copyright cases in Beijing. Among them, image copyright cases accounted for the largest proportion. From the establishment of the court on September 9, 2018 to June 30, 2020, the Beijing Internet Court has accepted a total of 64,473 cases, of which 49,855 were copyright cases, accounting for 77%, and image-related copyright cases accounted for more than half of all copyright cases.

 

The sixth group of reform pilot experience in the free trade zone will include the promotion of securitization of Intellectual Property


On July 7, the State Council issued the Notice of the State Council on Effectively Replicating and Promoting the Sixth Group of Experience in the Reform Pilot Programs of Pilot Free Trade Zones (hereinafter referred to as the "Notice"). The "Notice" pointed out that the localities and relevant departments of the Pilot Free Trade Zone, combined with the functional positioning and characteristics of their respective Pilot Free Trade Zones, have made every effort to promote institutional innovation practices, forming the sixth group of experience in the reform pilot programs of pilot free trade zones, which will be replicated and promoted nationwide. According to the "Notice", there are a total of 37 reform pilot experience replication and promotion, of which 31 are replicated and promoted nationwide, and 6 are replicated and promoted in specific regions.

 

Yunnan's patent electronic filing rate in the first half of the year reached 99.42%, ranking second in China.


On July 7th, it was learned from the Yunnan Provincial Market Supervision Administration that in the first half of this year, the electronic patent application rate in Yunnan reached 99.42%, ranking second in China.

From January to June 2020, the Yunnan Provincial Market Supervision Administration accepted a total of 2087 patent applications; handled 13 patent pledge registrations, involving 159 patents, with a pledge deposit amount of 429 million yuan; reviewed a total of 3046 applications for patent fee reduction documents for various innovative entities, including 1370 enterprises; 239 patent priority examinations. In accordance with the Provincial Funding Measures for Invention Patent of Yunnan Province, the Administration gives priority to the granting and maintenance of 479 invention patents in key industries, strategic emerging industries, and characteristic superior industries in Yunnan Province and provides more than 6,000 consultations through online and offline.

 

The Civil Code, which is scheduled to come into force in January 2021, will exert much influence on China's intellectual property legal system, according to experts.

The new code, which was passed by the National People's Congress in May, is a codification of civil statutes. It comprises 1,260 articles, more than 50 of them related to IP.

Liu Chuntian, a law professor at Renmin University of China, told that the Civil Code will have a "fundamental, systematic and decisive role" in China's IP legal system. Its philosophy and principles penetrate every rule in related acts and provide guidance for them, he added.

According to the code, the IP spectrum includes copyright works; patented inventions, utility models and industrial designs; trademarks; geographical indications; trade secrets; integrated circuit designs; and new plant varieties.
