On September 22, the National Intellectual Property Administration Trademark Office set up the first Trademark Circuit Review Court in Shanghai trademark examination cooperation center. It is the first trademark circuit review court in China. On September 23 and 24, Trademark Circuit Review Court has carried on the oral hearing dismissed '5G and figure' trademark review case and the 'thousand pages tofu', 'thousand pages', 'thousand pages and figure' and 'thousand pages tofu and figure' trademark overturned review case.
The trademark circuit review court will adhere to the goal of benefiting the public, give full play to the advantages of the local trademark review cooperation center, use the way of combining the circuit trial and written trial to find out the facts, settle disputes, safeguard the legitimate interests of the parties in accordance with the law, and actively maintain the market order of fair competition.
Since September 2019, the Trademark Office has conducted open circuit trials of trademark invalidation cases in Shanghai, Yiwu and Nanjing, which have received a good social response.
In order to further deepen the trademark facilitation reform and increase the power of the trademark review case circuit trial, the Trademark Office has chosen to set up the first Trademark Circuit Review Court in Shanghai Trademark Review Cooperation Center, which is the first circuit review case located outside Beijing.
"The settlement of the first Trademark Circuit Review Court in Shanghai is beneficial to further deepening the reform of the trademark registration facilitation, and strengthening the protection of intellectual property rights. It is another significant progress in the active service in Shanghai. It provides convenience for the parties to participate in the oral examination in Yangtze river delta region case review. It hopes that Shanghai Trademark Review Cooperation Center to take this chance to deepen the reform of the trademark registration facilitation; as well as optimizing business environment, and play a bigger role in serving the development of the Yangtze River delta integration." said Chen Xuejun, director of the Shanghai Market Supervision Administration.
