In order to solve the issue of figuring out the technical facts in intellectual property trial, Changchun Intellectual property Court took the lead in introducing the system of the technical investigation officer in Northeast China. The appointment ceremony was held this morning.
The first batch of technical investigation officers consists of a total of 31 people, who come from different professional and technical fields, teaching and research work, are equipped with solid theoretical foundation and rich professional experience. They are able to put forward professional, objective and neutral suggestions from the aspects of technical facts regarding the focus of dispute, investigation scope, sequence and method, etc.
Changchun intellectual property court was founded on December 26, 2018, and is the only professional organization engaged in the trial of intellectual property, and also the first in northeast's three provinces currently. The quantity of cases received in Changchun intellectual property court rises, including patent, new plant varieties, technical secrets, computer software and other professional technical strong cases increased significantly.
The existing forms of expert assistance and expert consultation are challenging to cope with the trend of intellectual property trial with the normalization of professional and technical issues, so it is imperative to establish the system of the technical investigation officer.
The experts employed will provide timely and powerful technical support for the trial on technical issues, improve the trial quality and efficiency of technical cases, and promote the specialization of intellectual property trial.
It is understood that the system of the technical investigation officer in China has gone through a process of continuous development and improvement. In 2019 the Supreme People's Court summarized the status of technical investigation officer pilot operation. It introduced "the Supreme People's Court about technical investigation officer provisions involved in the proceedings of the intellectual property cases. The operation of the technical investigation officer extended to the people's court that hears the intellectual property rights case, to improve the efficiency and accuracy of the investigation of technical facts. Technical investigation officers are trial auxiliaries who act as technical assistants to judge and assist them in understanding and identifying professional technical issues involved in a case.
