Recently, Jiangsu Province Yizheng People’s Court sentenced part of the defendants of the designated jurisdiction case-“215” series of the copyright infringement case. The Supreme People’s Court conducted concentrated trial and sentencing towards the twenty-four defendants, including Wang, Liu, and Xiao for copyright infringement crimes.
The trial found that since June 2016, Ma, Wen and others without permission from the copyright owner, utilize high-definition technology recorded films, and organized the personnel to sell to the cinema, making a profit, and gradually formed a Ma and Wen criminal groups.
The defendants, including Liu and Wang, joined the above criminal organizations to develop offline, produce and sell pirated films, provide after-sales maintenance and technical services, or provide equipment and technical support for their illegal activities.
Before the Spring Festival in 2019, the defendant Xiao pirated the movie including the upcoming Lunar New Year films “Wander earth”, “Crazy aliens”, “Speeding life” and “New King of the Comedy” that are bought from Ma. They forwarded them through Baidu network disk to other movie bar owner. It leads to the high-definition movie piracy was uploaded to “mp4” and “four seasons HD websites” and on the Internet a lot. By February 2019, the defendants, including Liu, had participated in the copying and distribution of more than 400 pirated films, with a total illegal business amount of 7.77 million yuan.
The defendant, Wang who has fully aware that Ma, Wen, Lu and other people to copy and distribute pirated films, he still provided encryption technology and equipment for the co-defendants illegally and caused the total illegal operating amount of 12.06 million yuan, the illegal income of a total of 688,000 yuan.
The Court held that the act of the defendant had constituted the crime of infringing copyright and should be punished by the law. Combined with the criminal facts, nature, status, the role of each defendant and the degree of harm to the society, the above judgment is made.
